Canada widens restoration options for out-of-status workers and students, allowing them to stay as visitors

Maple News reports that Canada has updated its immigration guidance to permit temporary residents who lose their status as workers or students to apply for restoration of status as a visitor. The change, announced on May 1, 2026, expands options beyond the former rule, which limited restoration to the same temporary status.

Under the newly published guidance from Immigration, Refugees and Citizenship Canada (IRCC), applicants may seek restoration as a visitor if they are within 90 days of losing status, remain in Canada while a decision is made, and continue to meet the conditions of the temporary status they are seeking to restore.

Importantly, submitting a restoration application—whether as a worker, student, or visitor—does not authorize work or study during processing. Individuals who lose their authorization must immediately stop working or studying.

For temporary foreign workers and international students who do not have an immediate path to a new work permit or study permit, the option to stay in Canada as a visitor during the restoration process is now available. Those pursuing this path must also apply for a visitor record, pay the applicable fees, and demonstrate they meet visitor requirements.

IRCC cautions that restoration is not guaranteed and processing times can vary. While the policy update provides a clearer, faster pathway to remain in Canada, applicants should prepare thoroughly and consider seeking professional guidance if needed.
