How International Students Can Legally Extend Their Stay in Canada

Maple News reports that international students studying in Canada on a valid study permit must take timely action if they wish to extend their stay or continue their academic journey beyond their initial permit dates. Study permits in Canada typically expire 90 days after the completion of a study program. If a student finishes the program earlier than expected, the permit still expires 90 days after the completion—not the original end date on the document.

To continue studying legally in Canada, students must apply to extend or change their study permit before the current one expires. Immigration, Refugees and Citizenship Canada (IRCC) strongly advises submitting the extension application at least 30 days before the permit expires. However, applying even earlier is recommended to avoid issues related to application processing delays.

For students enrolled in institutions in Quebec, a valid Quebec Acceptance Certificate (CAQ) is also required. If a CAQ is needed for a study permit, it must be renewed alongside the study permit itself.

If a student submits a renewal or extension application before the current permit expires, they receive what is known as “maintained status.” This allows them to stay in Canada and continue their studies legally while awaiting a decision from IRCC. However, if the permit expires before IRCC renders its decision and the student has not applied in time, they risk falling out of status.

In cases where the study permit has already expired and no extension was filed, the student loses their legal status in Canada. In this situation, the individual must stop studying immediately and apply for restoration of their status. This application must be submitted within 90 days of the permit expiring.

Restoring status comes with costs: a CAD $200 fee for restoration and an additional CAD $150 fee for a new study permit. During this period, students are not allowed to attend classes or continue their studies until their status has been successfully restored by the IRCC.
