What to Do If Your Canadian Citizenship Application Is Denied

According to Maple News, applicants who receive a refusal on their Canadian citizenship application from Immigration, Refugees and Citizenship Canada (IRCC) have two primary options: they can either reapply or pursue a judicial review through the Federal Court of Canada.

In 2023, more than 354,000 individuals officially became Canadian citizens, attending over 3,000 citizenship ceremonies nationwide. While this marks a slight decline compared to the 375,000 new citizens in 2022, the overall trend remains positive. Citizenship numbers have grown roughly 39% since 2019, when around 254,000 people were granted Canadian citizenship.

Despite this upward trend, a number of applications continue to be refused every year, often due to factors such as incomplete documentation, failing to meet physical presence requirements, or not passing the citizenship test. In such cases, applicants are not barred from applying again. IRCC clearly states that individuals whose applications are denied may submit a new application immediately, with no mandatory waiting period.

However, any subsequent application must include a new fee and all required forms and documents. IRCC advises applicants to thoroughly ensure they meet all eligibility requirements before reapplying, including language proficiency, taxes filed, and physical presence in Canada, among others.

Alternatively, if an applicant believes their refusal was made in error or based on procedural unfairness, they may request a judicial review by the Federal Court. This process allows a judge to review how the decision was made, though it does not guarantee a reversal. A successful judicial review can lead to the application being reconsidered, but it must be filed within 30 days of receiving a refusal.
