Maple News reports that foreign nationals currently in Canada under temporary resident status may be eligible to extend their stay, especially if they are unable to leave the country due to restricted international travel. Immigration, Refugees and Citizenship Canada (IRCC) has detailed the process for applying for an extension and emphasized that applications should be submitted before the current status expires.
To be considered for an extension, applicants must complete an online application and provide a clear explanation for why they are unable to depart Canada. This could include closed borders or suspended commercial flights to their home countries. Required application fees, including biometrics fees when applicable, must be paid. If biometrics cannot be collected, IRCC indicates those specific fees will be refunded.
Temporary residents who apply for an extension before their status expires may benefit from what is called ‘maintained status.’ This allows individuals to remain legally in Canada under their existing conditions until a decision is made on their application—removing the need for expedited processing.
No general fee waivers are in place for extension applications unless outlined through a special public policy. IRCC officers also cross-reference travel and repatriation options to ensure an applicant’s reasons for staying are valid.
For those whose temporary status has already expired, there’s still a possibility of restoring their status. Individuals have up to 90 days from the date their status ended to request restoration. They must pay the $200 processing fee along with the application. However, only those who had valid temporary residency between January 30, 2020, and May 31, 2021, and who remained in Canada since entry are eligible under this restoration provision.
If restoration criteria are met, the immigration officer may issue a visitor record or relevant permit, outlining the conditions associated with the new status. If the requirements are not met, the case will be reviewed by a Minister’s delegate, who may choose to refer the applicant to an admissibility hearing, issue a departure order, or allow continued residence in Canada.
